Here we've set out all the terms and conditions that apply to the awards themselves, to your use of this website, plus an explanation of our privacy policy.
These terms apply to the Lloyds TSB Enterprise Award Scheme held between 13 November 2011 and 13 March 2012 (the "Award Scheme").
Introduction
What is the Award Scheme?
It's a scheme run by us in association with the National Association of College and University Entrepreneurs ("NACUE") which recognises and supports emerging businesses in England, Scotland and Wales.
What do these terms apply to?
If you enter the Award Scheme, these terms apply to your participation and set out how we'll use information you provide. If you enter, you accept these terms.
Are there other terms I need to be aware of when entering?
Yes. As you're using our website to enter you'll also need to have read and agree to our website terms of use and privacy policy.
What awards are there?
There are two award categories- "Best Enterprise" and "Best Start-Up". These will be awarded at each of the eight local heats and at the grand final.
What is our definition of "Best Enterprise"?
A sole trader, partnership or limited liability business which in our opinion:
- demonstrates a robust business plan and sound financials;
- is innovative in terms of product or service or route to market, or way of running its business;
- identified a genuine business opportunity and need for its product or service;
- is professional and credible;
- shows real potential to grow successfully over the next 5 years and to become a recognised small medium enterprise within its respective sector; and
- is an inspiration to its peers and other would-be students and graduate entrepreneurs of the future.
What is our definition of "Best Start-Up"?
A sole trader, partnership or limited liability business which in our opinion:
- demonstrates a developed and well thought through business plan and an understanding of financials;
- identified an opportunity and seized the moment;
- is credible;
- has the potential to grow and become profitable; and
- is an inspiration to other would-be students and graduates who dream of setting up their own business and becoming their own boss.
Eligibility and entry
How do I enter?
Complete the online entry form. By entering you confirm that information you provide is correct and accurate.
Can I enter by post?
You can only enter using the online entry form.
Who can enter?
To enter:
- you must be aged 18 or over; and
- you must either be studying at, or have graduated no more than five years ago (since November 2006) from, a University in England, Wales or Scotland; and
- you must be an owner and founder or co-founder of an Enterprise or Start-Up business registered in England, Wales or Scotland that has been trading continually for more than one year; and
- you must not work for any company in our group (nor can anyone else who directly or indirectly owns all or part of your business). Our group includes Lloyds TSB, Halifax and Bank of Scotland. More information can be found at www.lloydsbankinggroup.com; and
- your business must not be a listed company (whether a plc, AIM or otherwise); and
- you, your business, your co-founders or co-owners (if any) must not have been disqualified as a director, barred from owning or managing a company, or involved in or convicted of any fraudulent or criminal activity, or been made or declared bankrupt.
When can I enter?
You can enter between 00:01 on Sunday 13 November 2011 and 23:59 on Monday 30 January 2012. Entries received outside this period won't be accepted. We're not responsible if you're unable to enter for any reason (including if our website is unavailable for any period) or if your entry is lost or not received by us.
How many times can a business be entered?
Once. If a business is entered more than once, we'll only count its first entry. We reserve the right to disqualify multiple or fraudulent entries.
As an individual you may enter more than once with different businesses (provided that in each instance you and the relevant business meet the eligibility criteria).
Do all owners of my business have to attend, or have graduated from, University?
No. Only the owner and founder (or co-founder) completing the entry form on behalf of the business needs to meet the entry criteria.
I understand the Award Scheme will have eight heats - where are they?
The eight local heats will be held in: Wales, Yorkshire and North East, Midlands, South West, South East, North West, East England and Scotland. Each area will have its own event.

Which area heat will my business be entered into?
Your business will be entered into the local heat which covers the postcode of the business' address you provided on your entry form.

The financial information you've requested is sensitive. Do I have to provide it?
All parts of the entry form must be completed. The financial details are an important part of the information you provide and will be used as part of the judging process by us, NACUE and the judging panels.
If you don't provide the information requested then we won't accept your entry and it'll be excluded from the Award Scheme. We'll have no further liability to you.
By entering the Award Scheme you acknowledge that you'll be required to provide audited/managed accounts (being accounts audited and managed by a registered accountant or book keeper).
I completed the entry form and you've now asked me for further information - do I have to provide it?
We may request further information (such as audited/managed accounts, financial details, proof of age, education, residency or of other eligibility criteria) after you've entered to enable us to better understand your entry, your business, your co-owners, or to verify any other aspect of your entry. Any audited or managed accounts we request must have been audited and managed by a registered accountant or book keeper.
If you don't provide this information, or if we can't verify any aspect of your entry within a reasonable time, we reserve the right to exclude your entry from the Award Scheme. We'll have no further liability to you if we do so.
I completed the entry form and you've now said that a Lloyds TSB Relationship Manager needs to inspect my business - do I have to let them?
We reserve the right to require a representative of us (a Lloyds TSB Relationship Manager) to inspect your business (this could be in order to better understand its background, the way it operates, your product or service, or to help verify any other aspect of your entry).
If you don't allow this inspection (where we require it), or if we can't otherwise verify any aspect of your entry within a reasonable time, we reserve the right to exclude your entry from the Award Scheme. We'll have no further liability to you if we do so.
Can you exclude an entry?
Yes. We may exclude an entry at any time (e.g. if it is incomplete, if we're unable to verify an aspect of it, if you (or your co-owners, co-founders or business) don't meet any of the entry criteria, if you use false names/addresses (whether for you or your business), if additional information isn't provided, we can't inspect your business, or if your business doesn't attend an event). We may also exclude entries where we reasonably believe that the entrant, the business or any aspect of the entry has or may bring us, our group and/or the Award Scheme into disrepute.
Where we exclude an entry, we'll have no further liability to the entrant or its business.
Charges
Do you charge businesses to enter?
No, we don't charge.
Can I reclaim any costs I incur in participating in the Award Scheme?
Except as set out below, no. We describe below some expenses we may cover, but otherwise any costs you or your business incur in participating in the Award Scheme or attending any events aren't covered by us, and you'll be responsible for all such expenditure (including travel, accommodation, living and sundry expenses).
Do you provide food and refreshments at the Award Scheme events?
Yes. We'll provide food and refreshments for you and any permitted guests at the relevant heat and national Award Scheme events.
Do you provide accommodation at the Award Scheme events?
We don't provide accommodation at the local heat events. However, if your business wins an award at one of the local heats and we invite you to attend the grand final event then, depending on your location and that of the grand final event, we may offer you accommodation on the night of the national event for you (the person completing the entry form) and up to 2 other representatives of your business. Where we do so, we'll let you know further details at the time.
Judging panel and selction processes
What is the selection process for the eight area events?
Stage 1
We will review all entries and create a shortlist of up to 10 businesses for the awards in each of the eight local heats. A maximum of 80 businesses will be shortlisted in the Award Scheme at this stage.
Stage 2
The shortlisted businesses will be announced in the Sunday Telegraph and on the Award Scheme website at www.lloydstsb.com/enterpriseawards on Sunday 5 February 2012. We'll then contact the shortlisted businesses. If we're unable to contact a shortlisted entrant by 5pm on Wednesday 8 February 2012 having used reasonable efforts to do so, their entry will be removed from the shortlist without any liability to us. Another business will be shortlisted to replace it. As a result please ensure that you are contactable during this period using the details you provided to us.
Stage 3:
The shortlisted businesses will be invited to attend their relevant local heat event where they'll be required to make a short presentation of 2 minutes to the judging panel followed by a question and answer session. They may bring along their product or a visual of their product provided that it can be carried onto the stage by one person.
Stage 4:
The judging panel will announce their two heat winners at the relevant event later that same day.
What is the selection process for the national event?
Stage 1:
The sixteen local heat winners will be invited to attend the national event where they'll each be required to make a short presentation of two minutes to the judging panel followed by a question and answer session. They may bring along their product or a visual of their product provided that it can be carried onto the stage by one person.
Stage 2:
The judging panel will announce the grand final winners of Best Start-Up and Best Enterprise at the grand final event later that same day.
How will my entry be judged?
We'll judge your entry using the information you provide on your entry form, any further information that we collect from you or third parties, your presentation(s), and the question and answer session(s) with the judging panel.
Who are the judges?
Each heat and grand final event will have its own judging panels. The judging panels will consist of representatives from a variety of sectors (for example, government, media, industry bodies, Lloyds Banking Group and local entrepreneurs).
Events
Do I have to attend the events?
Yes. They form an important part of the judging process (e.g. the presentations and question and answer sessions). If you don't attend the relevant event your entry and business will be excluded from the Award Scheme and will not be eligible to receive an award. In such circumstances, we'll have no further liability to you.
Who can attend the events?
If you're shortlisted for a local heat award, you may bring 1 other representative of your business to the event. If your business wins a local heat award, you may bring two representatives of your business to the national event.
Awards and prizes
How many award winners will there be?
There are eighteen awards in total - sixteen 16 local heat and two grand final. Grand final winners will have won their local heat award so there will be a total of sixteen winning businesses in all.
What are the area prizes?
The prizes for the local heat winning businesses are:
- "Best Start-Up" - £1,000 cash prize
- "Best Enterprise" - £5,000 cash prize
Each winning business will also receive mentoring from a local senior Lloyds TSB employee and will be entered for the national awards.
What are the national prizes?
The prizes given to a national winning business will be dependent on the prize it won at the local heat event. The maximum amount that a business can win across both the local heat and grand final awards is:
- "Best Start-Up" - £10,000
- "Best Enterprise" - £50,000
The amount received at a national level will therefore reflect the above figure less any cash prize won at a local heat event.
The two grand final winning businesses will also receive a two hour mentoring session with an executive Lloyds TSB employee.
Can a business win both the "Best Start Up" and "Best Enterprise" awards?
You can't win both awards at a single event (i.e. local heat or grand final). However, at the grand final event, local heat:
- Best Start-Up winners will be considered for both the national Best Start-Up and Best Enterprise awards.
- Best Enterprise winners will be considered for the national Best Enterprise award only.
How will I know if my business has won?
The winners will be announced at the relevant event. Details of winners will also be published through various media channels (including the Sunday Telegraph and www.lloydstsb.com/enterpriseawards.
How will the area cash prizes be paid to winning businesses?
Prize money will be paid by way of a cheque made payable to the winning businesses. Cheques will be given to representatives of the winners at the national event.
How will the national cash prizes be paid to the winning businesses?
Prize money will be paid into a Lloyds TSB business account in the name of the winning business. If you're business doesn't already have such an account with us, we'll open one using the information you provided (subject to successful credit check(s)).
The prize money for the national "Best Enterprise" award will be paid in three instalments: 20% within three working days of the national event; 40% within three months of the national event; and 40% within twelve months of the national event. The winning business will need to apply to us for release of the latter two instalments (and we reserve the right to require satisfactory information regarding the proposed use of these funds before releasing them (failure to provide which could delay or prevent their release).
Are there any restrictions on what I can do with the prize money?
Yes. All prize money must be re-invested into the winning businesses (e.g. in a marketing campaign, to purchase new vehicles or office equipment for the business) and must not be used for personal use or gain.
Awards are personal to the winning businesses and aren't transferable.
Are there any alternative prizes available?
No (although if part or all of a prize isn't available as a result of unforeseen circumstances, we reserve the right to offer an alternative prize of equivalent value in our sole discretion).
Contacting you...
If we're unable to contact a shortlisted entrant by 5pm on Wednesday 8 February 2012 having used reasonable efforts to do so, their entry will be removed from the shortlist without any liability to us. Another business will be shortlisted to replace it. As a result please ensure that you are contactable during this period using the details you provided to us.
We're not responsible for lost documents relating to the Award Scheme or prizes.
Your data
How do you use the information I provide in participating in the Award Scheme?
We'll use personal information you provide in order to administer the Award Scheme and as otherwise set out in our privacy policy. This includes using it to: (i) verify any aspect of your entry (such as your details, proof of age, education, residency or of other eligibility criteria), or (ii) better understand your entry, your business, your co-owners, or your business' eligibility, or (iii) contact you about this year's Award Scheme and to let you know about future Award Schemes, and (iv) provide any awards and prizes that your business may win.
If your business wins a national award, we may use information you've provided to set up a Lloyds TSB business account into which the prize money will be paid (and to credit check you and/or your business).
Where we've got your consent, we may also use your personal information to provide information about products or services from us, other companies in the Lloyds Banking Group and from selected third parties.
Do you share my information with third parties?
We'll share your information with other companies in the Lloyds Banking Group, NACUE, Telegraph Media Group Limited, and other third parties used to administer, provide or publicise the Award Scheme (this may include credit reference agencies).
Do I have to take part in publicity relating to the Award Scheme?
By entering the Award Scheme, you and your business agree to take part in any publicity and promotional activity we may reasonably require. Refusing to take part in such activity may result in the award and prize being withdrawn (at our discretion).
Do you record calls?
We may record or monitor calls (for example, to check we've carried out requests, to verify details of your entry and business, and to improve our services).
General information
I don't agree with your decision - can I challenge it?
No. Our decision is final and no correspondence will be entered into.
If I learn information about Lloyds Banking Group by taking part, am I obliged to keep it confidential?
Yes. By entering the Award Scheme, you agree to keep confidential any information that you learn about us and/or our group gained by taking part in the Award Scheme.
What happens if the Award Scheme is cancelled?
If we can't run the Award Scheme as a result of an issue beyond our control (e.g. technical failures, governmental or regulatory restrictions, fraud or other causes) we reserve the right to terminate, cancel, modify, postpone or suspend the Award Scheme (and to disqualify any person or business which may have caused or contributed to the issue).
Ending this agreement
Can I withdraw my entry?
Yes. You can withdraw at any time. If you do so, neither you nor your business will be eligible to receive any award or prize (and if you've been shortlisted, we'll remove you and shortlist a replacement business). We'll have no further liability to you.
Other information
- The promoters of the Award Scheme are Lloyds TSB Bank plc (registered in England and Wales under company number 2065, and with registered office at 25 Gresham Street, London, EC2V 7HN) and Lloyds TSB Scotland plc (registered in Scotland under company number SC095237 and with registered office at Henry Duncan House, 120 George Street, Edinburgh, EH2 4LH).
- These terms are in English. All communications between us will be in English.
- If we don't enforce any of these terms, we can apply them again at any time.

How your personal information is used by Lloyds TSB Bank plc as a result of you entering the Lloyds TSB Enterprise Award Scheme (the "Award Scheme")

2. Use of information collected
2.1 Domain name information that we collect isn't used to personally identify you and instead is aggregated to measure the number of visits, average time spent on this Website, pages viewed etc. We use this information to measure the use of our Website and to improve it's content.
2.2 Your personal information will be held securely by us, Lloyds Banking Group companies, the National Association of College and University Entrepreneurs ("NACUE") and Telegraph Media Group so that we and they can manage your relationship with us and them. This will include information you provide when you apply to us, and any additional information provided by you or others in various ways (including by you entering the Award Scheme, in emails and letters, during telephone calls, in surveys, when you attend the Award Scheme events, in presentations and "question and answer" sessions, through Lloyds Banking Group company websites and during reviews and interviews) and information collected by us from other organisations (such as credit reference agencies and fraud prevention agencies).
We won't retain your personal information for longer than is necessary, or as required by legal or regulatory obligations.
2.3 We may share the personal information we hold about you with other companies in the Lloyds Banking Group, with the National Consortium of University Entrepreneurs, with Telegraph Media Group Limited, and with other third parties who administer, provide or publicise the Award Scheme for the purposes of:
- providing you with information about the Award Scheme and the progress of your entry and ongoing participation (including if you do not complete your entry);
- providing you with information about important changes or developments in the Award Scheme;
- verifying your eligibility (and that of your business) to participate in the Award Scheme (including liaising with third party organisations such as Companies House and your quoted University);
- providing you with information about future Award Schemes we may hold or organise;
- responding to your enquiries and complaints;
- administering the Award Scheme and associated promotions;
- updating, consolidating, and improving the accuracy of our records;
- testing new systems and checking upgrades to existing systems;
- crime detection, prevention and prosecution;
- evaluating the effectiveness of marketing and for market research and training; and
- managing your relationship with the Lloyds Banking Group companies and the National Consortium of University Entrepreneurs.
Your personal information may also be used for publicity purposes relating to the Award Scheme or when required by law or where permitted under the terms of the Data Protection Act 1998.
2.4 Where you have consented, we may also contact you about products and services available from Lloyds Banking Group companies, and from selected companies outside the group. We may do this by post, phone, e-mail or SMS. You may opt out of receiving this information at any time if you change your mind by calling us, writing to us, or by responding to the message.
2.5 Making sure we deliver excellent service is very important to us and to do this various methods of communication may be used to keep you updated about the Award Scheme. Most of the time we'll communicate with you by telephone or e-mail although we may also post information to you (such as invitations to Award Scheme events if you're shortlisted).
If you need to email us then remember that the message may not be secure and there is a risk that it could be intercepted. If you choose to send us an email, please keep the amount of confidential information you include to a minimum.
In extraordinary circumstances (such as natural disaster or civil unrest) we may also send you updates by text message when we consider it to be appropriate.
2.6 We'll treat your personal information as private and confidential, but may share it with each other and disclose it outside the Lloyds Banking Group if:
- allowed by this Privacy Policy or the terms of the Award Scheme;
- you consent;
- needed by our agents, advisors or others involved in running the Award Scheme;
- needed by subcontractors to help us manage the Award Scheme;
- HM Revenue & Customs or other authorities require it;
- the law, regulatory bodies, or the public interest permits or requires it;
- required by us or others to investigate or prevent crime;
- needed by market research companies to assist us in providing a better Award Scheme;
- to any other parties connected with the Award Scheme; or
- required as part of our regulatory duties.
We'll always ensure your information remains safe and secure.
2.7 Lloyds Banking Group companies may in the future wish to sell, transfer or merge part or all of their business or assets, or any associated rights or interests, or to acquire a business or enter into a merger with it. If so, they may disclose your personal information to a potential buyer, transferee, or merger partner or seller and their advisers so long as they agree to keep it confidential and to use it only to consider the possible transaction. If the transaction goes ahead, they buyers, transferee or merger partner may use or disclose your personal information in the same way as set out in this notice.
2.8 The Data Protection Act defines certain information as 'sensitive' (racial or ethnic origin, political opinions, religious beliefs, trade union membership, physical or mental health, sexual life, criminal proceedings and offences). If you enter the award scheme, you may provide us with this type of information. We may share it with other parts of the Lloyds Banking Group, the National Consortium of University Entrepreneurs and our subcontractors to keep records up to date and to administer the Award Scheme.
2.9 All countries in the European Economic Area (EEA), which includes the UK, have similar standards of legal protection for your personal information. Lloyds Banking Group companies and companies acting on our behalf may run aspects of the Award Scheme and provide other services from centres outside the EEA (such as the USA and India) that don't have the same standard of data protection laws as the UK. However, if we or they do, we'll require your personal information to be protected to at least UK standards.
2.10 We will ask you to provide physical forms of identity verification when or after you enter the Award Scheme (for example, to verify your identity or eligibility to enter the Award Scheme).
2.11 We may monitor or record phone calls with you in case we need to check we have carried out your instructions correctly, to resolve queries or issues, for regulatory purposes, to help improve our quality of service, and to help detect or prevent fraud or other crimes. Conversations may also be monitored for staff training purposes.
2.12 As part of our ongoing commitment to understanding our customers better, we may research comments and opinions made public on social media networking sites such as Twitter and Facebook.
2.13 By using this Website you consent to us using your personal information for the purposes described above.
3. Use of cookies
3.1 In general you can visit Lloyds Banking Group websites without identifying who you are or revealing any information about yourself. However cookies are used to store small amounts of information on your computer to enable our server to collect certain information from your web browser. Cookies are widely used on the internet and in themselves don't identify the individual, just the computer used. 5. Accessing and updating your information
5.1 Under the Data Protection Act 1998 you have the right of access to personal data we hold about you. The Act allows us to charge a fee in providing you with the information (currently £10). If anything is inaccurate or incorrect you may ask us to make changes to ensure it is accurate and up to date. 5.2 You are responsible for informing us that your personal details have changed: for example, a change of address or to your title. You can do this by e-mailing us at enterpriseawards@lloydstsb.co.uk.

Any use of this Website other than in accordance with these Terms is prohibited. If you breach any of these Terms, your permission to use this Website automatically terminates and you must immediately destroy any downloaded or printed extracts from this Website.

3. Service access
